Welcome to MyKhata, a digital ledger (Digital Bahi Khata) application designed to simplify your business and personal financial management, along with additional features like resume generation, invoice creation, greetings card design, and EMI calculation.

These Terms and Conditions (“Terms”) govern your access to and use of the MyKhata mobile & Web application and any related services (collectively, the “App”). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By using MyKhata, you affirm that you are of legal age to form a binding contract in your jurisdiction and that you agree to comply with and be bound by these Terms.

2. Changes to Terms

We reserve the right to modify or update these Terms at any time. We will notify you of any changes by posting the new Terms within the App or on our website. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

3. User Accounts

  • Registration: To access certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with these obligations.
  • Single User: Each MyKhata account is intended for use by a single individual or business entity. Sharing account credentials is prohibited.

4. Use of the App

MyKhata provides a range of functionalities, including but not limited to:

  • Digital Ledger: Managing credit and debit entries, transactions, and customer accounts.
  • Invoice Generator: Creating and managing invoices.
  • Resume Maker: Generating resumes based on user-provided information.
  • Greetings Card Generator: Designing and personalizing greetings cards.
  • EMI Calculator: Calculating Equated Monthly Installments.
  • Split Expenses: Split expenses with any group, friends and family. 

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App for any illegal or unauthorized purpose.
  • Transmit any worms or viruses or any code of a destructive nature.
  • Attempt to gain unauthorized access to our systems or networks.
  • Interfere with or disrupt the integrity or performance of the App.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the App without our express written permission.

5. User Content

  • Responsibility: You are solely responsible for all data, information, text, graphics, photos, profiles, audio, video, and links (collectively, “User Content”) that you upload, post, or display on or through the App.
  • Accuracy: You represent and warrant that you have all necessary rights to your User Content and that your User Content does not infringe on any third-party rights, including intellectual property rights or privacy rights.
  • License: By submitting User Content to MyKhata, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the App and our business, including for promoting and redistributing part or all of the App (and derivative works thereof) in any media formats and through any media channels. This license will terminate upon your deletion of the User Content or your account, unless your User Content has been shared with others, and they have not deleted it.
  • No Obligation to Monitor: We are not obligated to monitor User Content but reserve the right to review and remove any User Content at our sole discretion.

6. Privacy Policy

Your use of MyKhata is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

7. Intellectual Property

  • App Ownership: The App, its original content, features, and functionality are and will remain the exclusive property of USHANAND INFOTECH SOLUTIONS PVT. LTD. The App is protected by copyright, trademark, and other laws of both India and foreign countries.

8. Fees and Payments (If applicable)

If MyKhata introduces paid features or premium subscriptions, the following will apply:

  • Pricing: All fees for paid features or subscriptions will be clearly stated within the App or on our website. We reserve the right to change our pricing at any time.
  • Payment: You agree to pay all applicable fees as they become due. Payments will be processed through third-party payment processors, and you agree to their terms and conditions.
  • Refunds: All sales are final. We do not offer refunds unless otherwise explicitly stated.

9. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. MyKhata makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App. To the full extent permissible by applicable law, MyKhata disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. MyKhata does not warrant that the App will be uninterrupted, secure, or error-free, that defects will be corrected, or that the App or the servers that make it available are free of viruses or other harmful components.

10. Limitation of Liability

In no event shall MyKhata, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Indemnification

You agree to defend, indemnify, and hold harmless MyKhata and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms; or c) User Content posted on the App.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Agra, Uttar Pradesh, India.

13. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the App.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MyKhata regarding your use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
